Prof. Imwinkelried Published in International Commentary on Evidence

Professor Edward J. Imwinkelried takes aim at evidentiary foul play in a commentary titled "Poetic Justice in Punishing the Evidentiary Misdeed of Knowingly Proffering Inadmissible Evidence" in a special issue of International Commentary on Evidence.

Professor Imwinkelried presented the paper at the 2009 meeting of the Association of American Law Schools' Evidence Section in San Diego.  In it, he refers to the knowing offer of inadmissible evidence as "one of the most extreme types of [evidentiary] misconduct."  As a remedy, he proposes "allowing the opposing litigant to treat the misconduct as admissible evidence of the other side's consciousness of the weakness of their side in the litigation."

Professor Imwinkelried is a world-renowned evidence expert and has published extensively in the field.
