Immigration Law Clinic Takes On Habeas Corpus Appeal

The UC Davis Immigration Law Clinic currently is pursuing a habeas corpus appeal in the Ninth Circuit Court of Appeals. The challenge was filed on behalf of a client who, though claiming to be a United States citizen, was unable to provide proof of citizenship when he was detained by authorities. The Real ID Act of 2005 limits the rights of immigrants, and those assumed to be immigrants, to challenge their custody through habeas corpus, making it difficult for already detained individuals to dispute their detention. The court's ruling on the appeal is pending.
