California Superior Court Judge Rules Proposition 22 Violates State Constitution

An Alameda County Superior Court Judge ruled the Proposition 22 enacted law, Business & Professions Codes 7448 as unconstitutional. The opinion states that the law is unconstitutional in several ways. First, it "limits the power of a future legislature to define app-based drivers as workers subject to workers' compensation law". Also, it requires provisions designed to prevent the Legislature from making significant changes to the law. Lastly, if a drivers status changed it may invalidate the rest of the law and prevent access to some of the benefits under the law. Backers of the law, gig economy companies like Uber, Lyft, and DoorDash, have indicated they will appeal the decision.
