Professor Lee Speaks at Washington University, Fordham, and University of Kansas

Professor Peter Lee was the guest speaker at two recent colloquia at the law schools of Washington University in St. Louis and Fordham University, where he presented his work-in-progress, "The Accession Insight and Patent Infringement Remedies."  Professor Lee also presented this project at the inaugural Patent Conference at the University of Kansas School of Law. 

Professor Lee's work-in-progress draws from physical property doctrine to argue that courts should extend liability rule protection to patents when they are infringed by substantially improved technologies.  Professor Lee situates his proposal within the context of a 2006 Supreme Court decision, eBay v. MercExchange, which introduced significant flexibility in how courts should protect patents after a finding of infringement.  Ultimately, Professor Lee's proposal seeks to enhance incentives for third parties to improve upon existing patented inventions while still providing adequate compensation to patentees.

Professor Lee's scholarly work addresses the intersection of science and society, particularly exploring the patent system's impact on scientific and technological progress.
