Adam Lewis '79 Helps Lead Morrison & Foerster Team in Supreme Court Bankruptcy Case Win

Adam Lewis '79 helped to lead a team of Morrison & Foerster attorneys in winning an important U.S. Supreme Court bankruptcy case on behalf of the firm's client, Amalgamated Bank. In a unanimous opinion in RadLAX Gateway Hotel, LLC v. Amalgamated Bank, the Court held that a Chapter 11 plan of reorganization that provides for a sale of a secured creditor's collateral free and clear of liens must afford that secured creditor the right to credit bid. The decision is significant because it protects secured creditors from undervaluation of their collateral in reorganization plans. Lewis is a senior counsel working out of Morrison & Foerster's San Francisco office.
