As usual, John Poulos' thoughts are turned to crime. "When you think of a crime, what are the fundamental requirements?" he asks. "There are many protections in the Constitution that apply to crime and criminal behavior, but often these protections are circumvented because we don't have a clear idea of what a crime is."
Full Biography...Such topics have long occupied Poulos, who has argued criminal cases-and particularly death penalty cases-at every judicial level in the land. "Most of what I teach deals with how the state exercises its power against the individual and how the individual can exercise his rights against the state," Poulos said.
In recent years, Poulos laments, the criminal law has become a whipping boy for political conservatives. The heritage of the Warren court-rules that would exclude evidence to penalize police misconduct-has been substantially eroded by subsequent decisions by the Burger and Rehnquist courts, he said. "Yet, I would be surprised if the Rehnquist court completely does away with these rules because it recognizes their value to political rhetoric," Poulos said.
In the meantime, he said, the question of how to deter police misconduct goes unanswered.
